Great analysis as always. To me, Trump, Musk and Cathie Wood all use the same playbook: destroy journalists by the inside dominating the Zeitgeist with stuff that are incredibly newsworthy.
To Musk's benefit, it's hard to argue what was the damage of all this stuff. The Tesla shareholder is very wealthy and his news-cycle bazooka is to the benefit of Tesla. I think that prohibiting Musk from tweeting would damage Tesla shareholders' that the SEC says to protect.
To me, this move solves to Musk some important problems
1) Musk assures a key input for his company. Portner all the way down.
2) This moves the public debate from the fact that Tesla missed expectations on the Q1 preview.
3) Musk gets to dominate the Zeitgeist once again for more 1-2 months from this.
Musk has now a whole new breadth of stuff about he can tweet, it increases his shitposting TAM. He maintains the optionality of further buying Twitter shares in the case of a new missed expectations from Tesla.
Why would the fact that he's an owner of Twitter affect his legal position when it comes to flaunting the SEC's rules?
